Education Next User Agreement

Welcome to Educationnext.org, the website of Education Next. Education Next, a journal of opinion and research, is a joint project of the Education Next Institute and President and Fellows of Harvard College (“Harvard University”). Educationnext.org is hosted by the Program on Education Policy and Governance at the Harvard Kennedy School. By accessing content on the Site, you agree to be bound by all of the terms of this User Agreement. Education Next reserves the right to change the terms of the User Agreement or to modify its features at any time. The Site will post changes to the terms of this User Agreement at https://www.educationnext.org/sub/user-agreement/ and by accessing the Site after modifications to this User Agreement have been posted, you agree to be bound by all the modified terms.

Use of Content

By accessing the Site, you agree to engage in only personal, noncommercial uses of Site Content or uses of Site Content for instructional purposes. Said “instructional purposes” shall include (but shall not be limited to) the incorporation of articles from the Education Next journal into assigned reading “coursepacks” and shall not include the incorporation of content owned by Education Next into scholarly publications. Without first obtaining our permission, you may not otherwise copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise make available any Site Content. You further agree not to modify, adapt, sub-license, translate, sell, reverse-engineer, decompile or disassemble any portion of the Site. For purposes of this Agreement, “Site Content” shall not include User-Generated Content that you personally submitted to the Site for publication.

User-Generated Content

The Site includes features that support and publish User-Generated Content, in the form of comments to articles, blog posts, and other Site-hosted fora. By accessing the Site, you agree that you will not make use of these features:

• To make comments that are threatening, knowingly false, or unlawful; using foul language; or to engage in personal attacks.
• To impersonate any person or entity or create a false identity on the Site.
• To disseminate or transmit “spam,” unsolicited messages, chain letters, advertisements, solicitations, or other unsolicited commercial communications, including (but not limited to) communications describing investment opportunities.
• To post material that infringes a copyright, trademark or patent right, trade secret or other legal right of any person, including Education Next.
• To collect, print out, reproduce, distribute, or otherwise make available or use any personally-identifiable information about other users.
• To disseminate or transmit viruses, Trojan horses, worms, defects, date bombs, time bombs, malware, spyware, or other items of a destructive nature or any other malicious code or program.

By submitting User-Generated Content for publication on the Site, you grant Education Next a perpetual, irrevocable, worldwide, transferable, royalty-free, and non-exclusive license to reproduce, publicly perform, publicly display, and distribute said content on the Site.

You understand and agree that Education Next monitors User-Generated Content on the Site and reserves the right to modify or remove any of said content at its discretion, without notice, and for any reason. Education Next assumes no responsibility for monitoring, modifying, or removing the Content on this Service.

You further understand and agree that the views and opinions expressed by other users on the Site are theirs alone and should not be ascribed to Education Next. Content created by third parties is the sole responsibility of the third parties and its accuracy and completeness are not endorsed or guaranteed by Education Next.

Registration, Privacy, and Termination of Access

Certain areas of the Site may require registration or may otherwise ask you to provide information in order to participate. The decision to provide this information is optional; however if you elect not to provide such information, you may not be able to access certain content or features. When you register, you agree to provide information to Education Next that is accurate, current and complete. You agree that the Site’s Privacy Policy governs the use of the information you report. Education Next reserves the right to terminate the registrations and otherwise deny Site access to any person who violates this User Agreement. The Site will not be liable for any loss or damage arising from your failure to protect your password or account information.

Online Purchases

If you make a purchase from Education Next or a third party merchant through the Site, the information obtained during your visit to the Site, and the information that you give as part of the transaction, such as your credit card number and contact information, may be collected by Education Next or the merchant. A merchant may have separate privacy and data collection practices. We have no responsibility or liability for these independent policies. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Site.

Disclaimer of Warranty/ Limitation of Liability

You agree that your use of the Site shall be at your sole risk. To the fullest extent permitted by the law, Education Next disclaims all warranties, express or implied, in connection with the Site and your use thereof. Education Next makes no warranties or representations about the accuracy or completeness of the Site’s content, including user-generated content, or the content of any websites linked to this Site and assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies in content; (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Site; (3) any unauthorized access to or use of Education Next’s secure servers and/or any and all personal information and/or financial information stored therein; (4) any interruption or cessation of transmission to or from the Site; (5) any bugs, viruses, Trojan horses, or the like which may be transmitted to or through the Site by any third party; and/ or (6) any errors or omissions in any content or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Site. You assume all risk as to the quality, function, and performance of the Site, and to all transactions you undertake on the Site, including without limitation submission of any user content.

You agree that Education Next and Harvard University will not be liable to you for any loss or damages, either actual or consequential, arising out of or relating to these terms, or your (or any third party’s) use or inability to use the Site, or your placement of content on the Site, or your reliance upon information obtained from or through the Site. In particular, Education Next and Harvard University will have no liability for any consequential, indirect, punitive, special or incidental damages, whether foreseeable or unforeseeable, (including, but not limited to, claims for defamation, errors, loss of data, or interruption in availability of data), arising out of or relating to these terms, your use or inability to use a site, or any purchases made on this Site or from a third party vendor authorized to sell goods and services through the Site on Education Next’s behalf, or your placement of content on a site, or to your reliance upon information obtained from or through a site, whether based in contract, tort, statutory or other law, except only in the case of death or personal injury where and only to the extent that applicable law requires such liability.

Indemnification

You hereby indemnify, defend and hold harmless Harvard University and all their affiliates, employees, faculty members, students, members of their governing boards and agents (collectively, the “Indemnified Parties”) from and against any and all liability and costs, including, without limitation, reasonable attorneys’ fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of these Terms of Service or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. Harvard University reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
